Terms and Conditions
The owner of the online store babymonitors.eu (hereinafter referred to as the Online Store) is Netigo OÜ (registry code 17153630), located at Siidisaba 10, Kristiine district, Tallinn, Harju County, 11311, Estonia.
Validity of the Sales Agreement, Product and Pricing Information
- These Terms and Conditions apply to purchases made from the Online Store.
- The prices of products sold in the Online Store are displayed next to each product. Delivery charges are added to the product price unless otherwise stated.
- Delivery costs depend on the buyer’s location and the selected delivery method. The applicable delivery fee is displayed during checkout.
- Product information is provided directly alongside each product in the Online Store.
Placing an Order
- To place an order, add the desired products to the shopping cart. To complete the order, fill in the required information and select the preferred delivery method. The total amount payable will then be displayed and can be paid via a bank link or another available payment method.
- The sales agreement enters into force once the amount due has been credited to the Online Store’s bank account.
- If an ordered product cannot be delivered due to being out of stock or for another reason, the buyer will be informed as soon as possible. Any amount paid, including delivery costs, will be refunded without delay and no later than 14 days after the notification has been sent.
Delivery
- Goods are delivered to the following countries: Estonia and Finland.
- Delivery costs are paid by the buyer, and the applicable price is displayed next to the selected delivery method.
- Deliveries within Estonia generally reach the destination specified by the buyer within 1–7 business days from the date the sales agreement enters into force.
- Deliveries within Finland generally reach the destination specified by the buyer within 2–8 business days from the date the sales agreement enters into force.
- In exceptional circumstances, delivery may take up to 45 calendar days.
Right of Withdrawal
- After receiving an order, the buyer has the right to withdraw from a contract concluded through the Online Store within 14 days.
- The right of withdrawal does not apply where the buyer is a legal entity.
- To exercise the 14-day right of withdrawal, the purchased goods may only be handled to the extent necessary to establish their nature, characteristics and functioning, in the same way as would normally be permitted when examining goods in a physical store.
- If the goods have been used beyond what is necessary to establish their nature, characteristics and functioning, or if they show signs of use or wear, the Online Store has the right to reduce the amount refunded in proportion to the reduction in the value of the goods.
- To return an item, please email us at info@beebimonitorid.ee. In your email, include your order number, the name of the product you wish to return and the reason for the return.
- Return shipping costs are paid by the buyer, except where the reason for the return is that the item does not conform to the order, for example where the wrong or a defective item was delivered.
- The buyer must return the goods within 14 days after submitting the notice of withdrawal or provide proof that the goods have been handed over to the carrier within that period.
- Upon receiving the returned goods, the Online Store will refund all payments received from the buyer under the agreement without delay and no later than 14 days after receiving the notice of withdrawal.
- The Online Store may withhold the refund until the goods have been returned or until the buyer has provided proof that the goods have been sent back, whichever occurs first.
- If the buyer has expressly chosen a delivery method that is more expensive than the least expensive standard delivery method offered by the Online Store, the Online Store is not required to reimburse the additional delivery cost.
- The Online Store has the right to withdraw from a sales transaction and request the return of the goods if, due to an error, the price of the goods in the Online Store has been listed significantly below the market price.
Right to Submit a Complaint
- The Online Store is liable for any non-conformity or defect in goods sold to the buyer that existed at the time the goods were delivered and becomes apparent within two years from the date of delivery.
- If a defect becomes apparent within the first six months after delivery, it is presumed to have existed at the time of delivery. The Online Store is responsible for proving otherwise.
- If a defect is discovered, the buyer has the right to contact the Online Store within two months by emailing info@beebimonitorid.ee.
- The Online Store is not responsible for defects that arise after the goods have been delivered to the buyer.
- If goods purchased from the Online Store have a defect for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If repair or replacement is not possible, the Online Store will refund all payments made by the buyer under the sales agreement.
- The Online Store will respond to a consumer complaint in writing or in a format that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data
- The Online Store uses personal data provided by the buyer, including their name, telephone number, email address and payment details, solely for processing the order and delivering the goods to the buyer.
- The Online Store shares personal data with companies providing delivery services only to the extent necessary to deliver the goods.
- The Online Store sends newsletters and promotional offers to the buyer’s email address only if the buyer has expressly agreed to receive direct marketing communications by entering their email address on the website and providing the relevant consent.
- The buyer may unsubscribe from promotional emails and newsletters at any time by contacting us by email or by following the unsubscribe instructions included in the promotional email.
Dispute Resolution
- If the buyer has any complaints regarding the Online Store, they should contact us by email at info@beebimonitorid.ee.
- If the buyer and the Online Store are unable to resolve a dispute by agreement, the buyer may contact the Estonian Consumer Disputes Committee. Information about the procedure and how to submit an application is available here.
- The Consumer Disputes Committee is authorised to resolve disputes arising from agreements concluded between the buyer and the Online Store. The review of a buyer’s complaint by the Committee is free of charge.
- The buyer may also use the European Union consumer dispute resolution platform.
